Terms of Use.
This is an original launch draft for Rarely. The operating company, supported regions, payment providers, fulfillment rules, and governing law must be confirmed and reviewed by qualified counsel before commercial release.
1. Agreement and scope
These Terms of Use govern your access to the Rarely website, mobile application, and related services (together, the “Services”). “Rarely,” “we,” “us,” and “our” refer to the operator identified in the official Rarely app-store listing or in-app legal notice. “You” means the person using the Services.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms displayed for a specific promotion, pack, collectible, shipment, or feature form part of these Terms for that activity.
2. Eligibility and accounts
2.1 Eligibility
You must be at least 18 years old and have legal capacity to enter into a contract, unless a higher age is required where you live. The Services are not available where their use would violate applicable law.
2.2 Accurate information
You must provide accurate, current information and keep it updated. If identity, age, location, payment, or delivery verification is required for a feature, you must complete it through the approved process before using that feature.
2.3 Account security
You are responsible for safeguarding your device and credentials and for activity carried out through your account. Notify Rarely through the official support channel if you suspect unauthorized access. Accounts may not be sold, transferred, or shared.
3. Packs and collectible reveals
A Rarely pack is an offer to receive a randomly selected collectible or other clearly described item from the pool shown before purchase. The applicable product page will describe the price, available item pool, stated probabilities or rarity distribution, format, and any limits.
- Images may be illustrative; condition, finish, serial number, and packaging can vary where disclosed.
- Availability and stated probabilities may differ by pack, edition, time, and region.
- A reveal is not an investment product, savings product, wager, or promise of profit.
- Market references are estimates only and may change quickly.
You are responsible for reviewing the complete pack information before purchasing. We may correct obvious display, inventory, or technical errors and will provide any remedy required by applicable law.
4. Purchases, payments, and refunds
Prices, taxes, fees, accepted payment methods, and any currency conversion will be shown before you confirm a purchase. Payment processing may be provided by a third party under that provider’s own terms and privacy notice.
Except where required by law or expressly stated at checkout, a completed reveal cannot be canceled or exchanged merely because you prefer another possible item. Duplicate, unauthorized, failed, or technically incomplete transactions will be investigated using account and payment records. Approved refunds are returned to the original payment method where possible.
You may not use a payment method without the account holder’s authorization, initiate abusive chargebacks, or attempt to exploit pricing, promotional, or payment errors.
5. Collection, custody, and delivery
A revealed item will be recorded in your Rarely collection after the transaction is confirmed. The product page or in-app record will state whether an item is digital, physically held for you, eligible for delivery, or subject to another fulfillment method.
Where storage or delivery is offered, you must provide a complete deliverable address and pay displayed shipping, insurance, customs, or tax charges. Delivery times are estimates. Risk and title transfer at the point required by the applicable offer and law. We may use specialist storage, grading, authentication, or logistics providers.
Report a missing, damaged, or incorrect delivery through the official support channel within the period shown in the app or delivery notice. Keep all packaging and evidence until the review is complete.
6. Trading, sale, and value features
If Rarely enables trading, resale, buyback, wallet, or withdrawal features, separate in-app terms will explain eligibility, fees, timing, verification, valuation, and settlement. A displayed value is not guaranteed unless an active, time-limited offer expressly says otherwise.
Collectible values may rise or fall and liquidity is not guaranteed. You are responsible for your own tax obligations and should obtain independent advice when needed. Do not purchase primarily in expectation of financial gain.
7. Responsible use
Rarely is designed for entertainment and collecting. Set a budget, take breaks, and do not use money needed for essential expenses. Our Responsible Purchasing Policy provides additional guidance and explains how to request support, a cooling-off period, or account closure.
8. Acceptable use
You must not:
- break the law, infringe another person’s rights, or use the Services for fraud;
- interfere with security, authentication, pricing, probabilities, inventory, or platform integrity;
- use bots, scripts, emulators, multiple accounts, or coordinated activity to obtain an unfair advantage;
- reverse engineer, scrape, copy, resell, or commercially exploit the Services except where law expressly permits;
- upload malware, abusive content, or information you are not authorized to provide; or
- evade account restrictions, geographic limits, purchase limits, or responsible-use controls.
We may investigate suspected abuse, preserve relevant records, restrict transactions, and cooperate with lawful requests.
9. Intellectual property and feedback
Rarely and its licensors own the Services, software, visual design, trademarks, and original content. These Terms give you a limited, revocable, non-transferable right to use the Services for personal, lawful purposes. They do not transfer ownership of Rarely intellectual property.
Third-party collectible names, artwork, and trademarks belong to their respective owners. Reference to a third-party property does not imply sponsorship unless expressly stated. If you provide feedback, you permit us to use it without restriction or compensation.
10. Suspension and termination
You may stop using the Services and request account closure through the official support channel. Before closure, complete any required withdrawal, delivery, or other account steps shown in the app.
We may restrict or terminate access when reasonably necessary to protect users, investigate suspected misconduct, comply with law, address payment risk, or discontinue a feature. Where appropriate and lawful, we will provide notice and a reasonable opportunity to resolve outstanding items.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted access, that every error will be corrected immediately, or that a collectible will maintain any particular value. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
12. Liability
To the fullest extent permitted by law, Rarely is not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, opportunity, data, or collectible value. Any aggregate liability arising from the Services will not exceed the greater of the amount you paid Rarely during the six months before the event giving rise to the claim or the minimum amount required by law.
These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot legally be limited.
13. Changes, law, and contact
We may update these Terms to reflect product, legal, or security changes. The effective date will appear at the top, and material changes will be communicated as required by law. Continued use after the effective date means you accept the updated Terms.
Applicable law and any mandatory dispute forum will be identified for your region in the final operator notice. Mandatory consumer protections in your home jurisdiction remain unaffected.
For questions, complaints, account access, or legal notices, use the verified support channel in the Rarely app or official app-store listing. Do not send passwords, complete payment card numbers, or identity documents by ordinary email.
